Terms & Conditions

We provide an online company registration facilitation service. Our services include, but are not limited to:

• Facilitation of company name reservation and registration with the Companies and Intellectual Property Commission (CIPC)
• Preparation and submission of registration documents including COR14.3 and Memorandum of Incorporation (MOI)
• Issuance of a share certificate upon successful registration
• Access to an online dashboard to track your application status
• Optional add-on services including domain registration, website design, virtual address, VoIP number, and business email

We act as an authorised agent facilitating the registration process on behalf of the applicant. We do not guarantee CIPC approval of company names or registration, as final decisions rest with CIPC.

By using our Platform, you confirm that:

• You are at least 18 years of age
• You have the legal capacity to enter into a binding agreement
• You are applying on your own behalf or are duly authorised to act on behalf of a third party
• All information you provide is accurate, current, and complete

The registration fee is R 885 (inclusive of VAT), which covers:

• CIPC company name reservation and registration fees
• Memorandum of Incorporation (MOI)
• Share certificate
• Processing and support by our team

Payment is processed securely via PayFast, a PCIDSS-compliant South African payment gateway. Your application is only submitted to CIPC after payment is confirmed. We do not store credit card or banking details.

Add-on services are subject to their own pricing as displayed on the Platform and are invoiced separately.

We offer a refund under the following conditions:

• Before CIPC submission: A full refund may be requested within 24 hours of payment, provided no application has been submitted to CIPC.
• After CIPC submission: No refunds are available once the application has been submitted, as CIPC charges are non-refundable.
• Name rejection by CIPC: If all four proposed names are rejected, we will submit alternative names at no additional charge or provide a partial refund of the Amashad processing fee.

Refund requests must be made in writing to info@amashad.co.za.

Typical CIPC processing times are 3–5 business days from the date of submission. These timelines are estimates and may vary due to CIPC system capacity or public holidays. We are not liable for delays caused by CIPC or factors beyond our control.

You agree to:

• Provide accurate and truthful information throughout the registration process
• Upload valid, legible, and authentic identification documents
• Ensure that proposed company names comply with CIPC naming guidelines
• Not use our services for unlawful, fraudulent, or deceptive purposes
• Keep your account credentials confidential

We reserve the right to suspend or terminate your application if we detect fraudulent, false, or misleading information.

All content on the Platform, including text, graphics, logos, and software, is the property of Amashad Company Registration (Pty) Ltd or its licensors and is protected under South African copyright law. You may not reproduce, distribute, or create derivative works without our prior written consent.

To the maximum extent permitted by law, Amashad Company Registration (Pty) Ltd shall not be liable for:

• Rejection of company names or registration applications by CIPC
• Delays in processing caused by CIPC or third-party service providers
• Any indirect, incidental, or consequential loss arising from use of the Platform
• Loss of data or interruption of service beyond our reasonable control

Our total liability to you shall not exceed the amount paid for the relevant service.

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the South African courts.

We reserve the right to update these Terms at any time. Material changes will be communicated via the Platform or email. Continued use of our services after changes constitutes acceptance of the revised Terms.
